Agreement/Contract between Customer and West Coast Storage, LLC
The general terms and conditions under which West Coast Storage, LLC operates, including the transportation / movement and storage of personal objects of Customer including, but not limited to, all appliances and parcels. The right to amend any portion of this agreement, and/or any other portion of the service provided, is fully reserved by West Coast Storage, LLC at all times. When delivery / shipping options become available, any terms concerning this service may be found on our shipper's website (TBA). All shipped items must be within the confines of the PackMyDorm.com standard box. The box must be no more than 70 (seventy) pounds in
weight, and if this weight limit is exceeded the customer will be charged a fee of $25 (twenty-five) dollars or double the shipping price up and until 120 (one hundred twenty) pounds. We do not ship boxes weighing greater than 120 pounds.
SERVICES
West Coast Storage, LLC requires that the Customer be present at the time of pickup. West Coast Storage, LLC solely and fully reserves the right to store the Boxes at an appropriate storage facility of its choice. West Coast Storage, LLC will return the Boxes to the Customers at the times scheduled from a list chosen by West Coast Storage, LLC in regards to school and dormitory schedules in both the Spring and Fall semesters. West Coast Storage, LLC requires the Customer to agree
to be present at the date, time and location of the scheduled drop off under penalty of monetary fines as described below in the Pricing section. The box in which the Customer places his/her belongings remains the property of West Coast Storage, LLC. It is the Customer's obligation to return the box if asked by West Coast Storage, LLC to do so. The Pick-up, Delivery, and Supply sections are not guaranteed by West Coast Storage, LLC for Customers who do not live in university housing. Agreements must be made separately, and at the time of purchase. If no agreements are made at that time, the Customer agrees to abide by provisions made solely by West Coast Storage, LLC. The Customer's belongings, including anything that is stored, transported, picked up and/or delivered by West Coast Storage LLC and / or its
shipping provider (hereinafter known as "Boxes"), shall become the possession of West Coast Storage, LLC limited to the duration of the storage period solely for storage purposes. The Customer soley may revoke this right of possession at any time, or demand the Box at any time (subject to scheduling and handling fees as described in the Payment section).
The Customer agrees that he/she may only access his/her Box only with prior notice to West Coast Storage, LLC and must pay a fee described in the Pricing section below. The Customer agrees that he/she may have his/her Box shipped outside the scheduled times only with prior notice to West Coast Storage, LLC and must pay a fee described in the Pricing section below. If the Customer must change the scheduled delivery date and / or time, it must be made known to West Coast Storage, LLC at least twenty-five (25) days prior to the original date. The Customer understands that changes within the aforementioned time period will be assessed a fee as described in the Pricing section and the change will not be guaranteed by West Coast Storage, L.LC.
SHIPPING
By initiating a contract, the customer accepts the terms and conditions of our shipping agent, who may or may not been known at the time, and the terms and conditions of West Coast Storage, LLC. The customer recognizes that West Coast Storage, LLC will be handing the package(s) off to an external, unaffiliated shipping company and all insurance claims must be brought up with that shipping company. West Coast Storage, LLC will purchase insurance equal to the amount purchased by the customer from the shipping agent and apply that towards the shipments of the customer. The amount that each item is insured can be found in the insurance section of this document. After the products have left West Coast Storage, LLC's warehouses, West Coast Storage LLC assumes zero liability for any of the items that were released to the carrier. In order to aid the customer in their interactions with the shipping agent, tracking numbers will be provided within a reasonable amount of time.
SUPPLY
West Coast Storage, LLC offers boxes and other packing supplies to Customers for fees described in the Pricing section. All supplies are delivered by West Coast Storage, LLC to the Customer. Delivery of the aforementioned products is not guaranteed for Customers who do not live in university housing. Agreements must be made separately, and at the time of purchase. If no agreements are made at that time, the Customer agrees to abide by provisions made solely by West Coast Storage, LLC. The Customer must be present during delivery. If the Customer is not present, a West Coast Storage, LLC representative will leave the supplies at the door of the Customer or in the mail room of the building and West Coast Storage, LLC's liability of the aforementioned items will cease at that time. West Coast Storage, LLC
will notify the Customer of the actions taken. West Coast Storage, LLC does not guarantee both the supplies availability and / or adequacy.
PICKUP
The pickup of the Boxes from the Customer will take place either at the door of the Customer's room or at the entrance of the Customer's building / house, as determined by residency and / or university rules. The Customer understands that the Boxes will be delivered at the scheduled time with a window no greater than six (6) hours. The
Customer agrees to be present, unless agreed upon in writing ten (10) days before the pickup date. Upon the fact that the Customer is not present, a monetary penalty found in the Pricing section may be applied.
DELIVERY
West Coast Storage, LLC is not liable for any damage of the Boxes and / or the Customer's belongings before pickup or after delivery. Delivery drop off times / dates / windows are similar to that listed in the aforementioned Pickup section. At the discretion of West Coast Storage, LLC, depending on residency and / or university rules, the Boxes may be delivered to the Customer's room. The Customer understands that he / she may have to retrieve his/her Box from a common area or a mail room. The delivery date is the date when the Box is delivered to the Customer's room, a common area, or a mail room, and not the date when the Customer retrieves the Box. The Customer agrees to sign for the receipt of the Box at which time West Coast Storage, LLC's liability ceases. The Customer agrees that any damage to the box must be noted at this time. The Customer must be present to do so. If the Customer is not present, a West Coast Storage, LLC representative will leave the Box at one of the aforementioned places and West Coast Storage, LLC's liability ceases. In this case, the signature of a West Coast Storage, LLC representative will be evidence that the Box was delivered in good condition. Only damage to the exterior of the Boxes will be grounds to initiate an insurance claim as described in the Insurance section of this
document. The Customer agrees that claims can only be made due to loss or damage caused by the negligence of West Coast Storage, LLC.
SERVICE GUARANTEE
In the event West Coast Storage, LLC fails to uphold the aforementioned agreements, West Coast Storage, LLC will issue a credit in an amount which is the sole discretion of West Coast Storage, LLC.
This is subject to the following conditions:
1. The Customer has not tampered with / removed any label from the box. The box remains property of West Coast Storage, LLC. 2. The Customer was present during pickup / delivery. 3. The Customer has provided West Coast Storage, LLC with all needed information. 4. The Customer notifies West Coast Storage, LLC in writing with a claim within eight (8) days of the agreed upon scheduled delivery. 5. Claims can not be made against West Coast Storage, LLC for any failure to delivery and / or pickup as agreed upon due to causes out of the control of West Coast Storage, LLC including, but not limited to, acts of God, refusal to accept and / or deliver the Boxes by the Customer, public authorities acting with apparent or actual authority, police acts, strikes, riots, civil unrest, accidents, hurricanes, acts of Godzilla, disruptions in ground transportation networks, such as weather phenomena and / or traffic, and other natural disasters.
COMMODITIES HANDLED AND RESTRICTIONS ON SERVICE
West Coast Storage, LLC has many restrictions on the items stored. If these restrictions are not abided by the Customer, the Customer accepts full monetary responsibility and liability for any damages or losses to the Customer's Boxes and / or other Customer's boxes due to the Customer's failure to acknowledge the restrictions. Upon purchasing a service from West Coast Storage, LLC, the Customer agrees not the store belongs which are restricted by West Coast Storage, LLC.
West Coast Storage, LLC shall not render storage service:
1. In the event that all articles within a single package have a value of more than one hundred dollars ($100 USD), or that all articles within all collective packages have a value of more than five hundred dollars ($500 USD).
2. For belongings / items including hazardous materials and / or firearms.
3. For belongings / items prohibited by law or regulation of state, federal, of local government in the United States.
4. For belongings / items such as perishable items or any type of food or beverage.
5. For belongings / items of any liquid form.
6. For belongings / items such as jewelry, cash, any type of money in any form, and / or collectibles.
7. For belongings / items that are prohibited by any partner of West Coast Storage, LLC or that are listed on any place of West Coast Storage, LLC's Website.
West Coast Storage, LLC reserves the right to refuse any package for any reason. West Coast Storage, LLC reserves the right to open and inspect any package tendered to it. The Customer is the sole person responsible for the safe packing of the Boxes. The Customer understands that he/she must sufficiently pack the box in order to withstand some shock, compression and vibration, and other movements of normal transportation. West Coast Storage, LLC assumes no liability for damage due to poorly packed boxes.
PAYMENT
The Customer agrees to pay in total at the time of ordering the service and /or supplies from West Coast Storage, LLC. The Customer also agrees to be bound to and pay any and all fees listed in the Pricing section that may be applicable. The Customer agrees to pay by a valid credit card or PayPal account. West Coast Storage, LLC
reserves the right to hold any Customer's Boxes or belongings until all assessed fees are paid in full. The Customer agrees to give the right to West Coast Storage to charge the Customer's credit card / PayPal account any outstanding fees before delivery of the Customer's belongings. Any prior agreements for scheduled times are null if the Customer does not pay his/her balance in full. The Customer understands that he/she remains indebted to West Coast Storage, LLC for any rejected / invalid form of payment or for any other reasons that causes West Coast Storage, LLC not to receive owed money. As previously mentioned, the holding of belongings by West
Coast Storage, LLC and / or delay of delivery may occur. Additional fees may also apply as per the Pricing section.
PRICING
Pricing for the services can be found on the West Coast Storage, LLC Web Site (http://www.packmydorm.com) which are subject to change without notice. Furthermore, West Coast Storage, LLC reserves the right to charge and the Customer will pay additional fees as described below. Fees are charged due to additional costs incurred by West Coast Storage, LLC. All fees are per-box. Fees outside of the standard service fees may be charged for: Redelivery After Failed Attempt -
$75, Summer Access - $200, Pick-Up or Delivery Outside Standard Dates - $75, Late Change of Delivery Day or Location - $50, Billing Fee - $20, Additional Abandonment Fees - Costs incurred in the case that the items are not claimed by the Customer.
INSURANCE
West Coast Storage, LLC protects / insures all Boxes in the case of loss or damage automatically for up to one hundred dollars ($100 USD). The customer acknowledges that no single box has a value of more than one hundred dollars ($100 USD) and that West Coast Storage, LLC is not liable to pay any single Customer more than five hundred dollars ($500 USD). The value recorded by the Customer must not exceed one hundred dollars ($100 USD). The Customer agrees that the actual value of the Boxes is less than or equal to the recorded value. Additional insurance, exceeding the automatic one hundred dollars ($100 USD) may be purchased for a fee at the time of buying the service. The amount that each item is insured is equal to the total insurance amount divided by the number of items. All items stored will
be insured for the same amount of money. The insurance rate is specified on the West Coast Storage, LLC Website. West Coast Storage, LLC's insurance policy has certain restrictions which will be further described. The Customer agrees to assume all risk of loss or damage. West Coast Storage, LLC and West Coast Storage, LLC's agents, affiliates, authorized representatives and employees are not responsible for any loss, liability, claim, expense, damage to property or injury to persons that could have been insured but was not (including without limitation any loss arising from the active or passive acts, omission or negligence of West Coast Storage, LLC or its agents, affiliates, authorized representatives and employees).
West Coast Storage, LLC's insurance does not cover:
1. Cash and any other monetary item.
2. Jewelry and collectables.
3. Unpacked items.
4. Damage that existed prior to the use of the service.
5. Damage to equipment, including by not limited to electronic
equipment, in which there is no evidence of physical damage.
6. Fragile items such as mirrors.
7. Belongings that have intangible or sentimental value.
8. Damage due to normal handling and transportation.
9. Damage that is concealed.
10. Poorly or inadequately packed items.
11. Damage to storage containers.
12. Damages due to forces outside the hands of West Coast Storage, LLC
such as natural disasters.
13. Damage to items after West Coast Storage, LLC's liabilities cease.
14. Damage due to the packing of aforementioned restricted items.
As previously mentioned, items must have physical damage to the exterior of the packaging. West Coast Storage LLC will not be liable for any damage that is concealed or is within an undamaged package and the Customer releases West Coast Storage LLC from any damage within this realm. West Coast Storage, LLC will not be held liable for this type of damage. As previously mentioned, the Customer is held responsible and is monetarily liable for damage that his / her belongings cause to other
Customer's belongings. Notwithstanding anything to the contrary contained in this Agreement, West Coast Storage, LLC's maximum liability for any claim is limited
by the terms included in this Agreement. All insurance coverage is limited to the period in which the Customer's possessions are in the custody of West Coast Storage, LLC beginning after pickup and ending after delivery as described above.
CLAIMS
West Coast Storage, LLC requires the Customer to agree to first claim loss or damage with personal insurance coverage before making claims with West Coast Storage, LLC upon purchase of the services. If a claim is to be made, the damaged package must be inspected by and in the presence of a West Coast Storage, LLC representative at the time of delivery to confirm any claims. The box must be opened at that time for the West Coast Storage, LLC representative to assess and
document the damage. The Customer must notify the West Coast Storage, LLC representative at the time of delivery if a box is lost and sign the proper documents. Missing items must be handled in a similar manner. If the Customer is not present, a West Coast Storage, LLC representative will determine if there is any damage or loss. All claims must be made by requesting a claim form from West Coast Storage, LLC. If no claim is made within ten (10) days of delivery, it shall be determined that there is no claim present and any claim after that time will not be honored. West Coast Storage, LLC will process any legitimate claim within thirty (30) days of receipt. West Coast Storage, LLC will pay the lesser of the following: a) cost of restoring the item, replacing the item, or the amount of insurance on the package ($100 or the amount purchased up to $3000 as described above). West Coast Storage, LLC shall have no liability for any claim payment that is denied by the Customer.
ABANDONMENT
West Coast Storage, LLC retains the right to assume ownership of any box that is unclaimed after December, 30 of the service year. The Customer agrees to pay West Coast Storage, LLC any fees that it incurs with the removal (shipping to the permanent address provided by the Customer) or disposal of any abandoned items.
EXTENDED PERIOD STORAGE PRICING
Purchasing storage entitles the customer to storage for the period between the pickup time they select and the delivery time they select. Delivery times are typically set up 3 times per year (end of summer, end of fall semester, end of spring semester). If a customer intends to store their item for multiple periods, they will be billed
accordingly - their storage item price multiplied by the number of periods the item is held for each stored item. Please contact us to receive the exact dates for your school to learn the exact dates associated with your campus if you have questions. All dates and periods are subject to change without notice at the sole discretion of West Coast Storage, LLC
CANCELLATION POLICY
No customer may cancel an order after seven (7) days and/or one (1) week of their given campus' first day of moveout. Whichever comes first in the previous statement is applicable.
LIMITATION OF LIABILITY AND REMEDIES
WEST COAST LLC SHALL NOT BE RESPONSIBLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES AS A RESULT OF ITS FAILURE TO PERFORM ANY OBLIGATIONS HEREUNDER. THE SOLE AND EXCLUSIVE REMEDY THAT A CUSTOMER IS ENTITLED TO WITH RESPECT TO ANY BREACH OF AN OBLIGATION BY WEST COAST LLC IS TO MAKE A CLAIM OF NO MORE THAN $100 PER BOX AS SPECIFIED IN THE INSURANCE SECTION OF THIS AGREEMENT. IN NO CIRCUMSTANCES SHALL WEST COAST LLC BE LIABLE TO CUSTOMER FOR ANY AMOUNT IN EXCESS OF $100 PER BOX OR $3,000 IN AGGREGATE. It is understood that West Coast LLC is not an insurance company or insurance broker and is not a professional mover, common carrier, or storer, and waives and shall not hold West Coast LLC to compliance of any local, state or federal laws regarding the same.
APPLICABLE LAW
This Agreement shall be governed, interpreted, and construed according to the law of the State of California. The Customer agrees that any court action pertaining to this agreement shall be conducted in courts in the State of California.
ENTIRE AGREEMENT
The Customer acknowledges that there are no representations, warranties, or Agreements by or between the parties which are not fully set forth herein. No individual inclusive of representatives of West Coast Storage, LLC or West Coast Storage, LLC's agents is authorized to make any representations, warranties, or Agreements
other than as expressly set forth herein. This Agreement may only be amended by a writing signed by both parties prior to initiating the transaction.
